      Check this box if you are an employer located in California and you will be ordering a credit report on your job applicant. You MUST check the box for the specific reason that you will be ordering a credit report. Please have your applicant sign this form and provide it to us with your order. If you are ordering online, please scan and upload this form in the system at the time you place your order.

      Fair Credit Report Act Summary of Rights and California Summary of Rights

      Before ordering a background check, you must provide the applicant with a copy of their summary of rights under the Fair Credit Reporting Act, and, if they are a California Resident, a copy of the California Summary of Rights (Section 1786.22).

      The Fair Credit Reporting Act (FCRA) states if you will be declining the applicant a position with your company based in whole or in part on information contained the background check, before taking any action, you first must send the applicant a pre-adverse action letter. This provides the applicant the opportunity to review the background check and to dispute any information they feel might be inaccurate. If they dispute the information, we must do a re-investigation. DataCheck will contact you immediately if a dispute is received. At the end of the re-investigation, we will notify you and the applicant of any changes to the background check report. When sending the pre-adverse action letter, you must include a copy of our background check report, a copy of the FCRA Summary of Rights, and, if they are a California Resident, a copy of the California Summary of Rights (Section 1786.22)

      If, after 7 days from the date you have mailed the Pre-Adverse Action letter, you have not heard from your applicant, or we have not received a dispute by the applicant, you may then proceed to send them the Adverse Action Letter, or as an alternative, you may also notify them electronically or orally. If you notify the applicant orally or electronically, be sure to include the information supplied in the Sample Adverse Action letter. Be sure to include a copy of our background check report, a copy of the FCRA Summary of Rights, and, if they are a California Resident, also give them a copy of the California Summary of Rights (Section 1786.22).
